Abstract
This thesis analyzes, from the perspective of private international law, the data privacy issues arising from the utilization of artificial intelligence tools in international arbitration and mediation proceedings. The systemic conflict between the territorial scope of the European Union’s Regulation 2016/679 (GDPR) and the principle of confidentiality in international arbitration is examined. A comparative analysis of the regulatory frameworks and practices of the European Union, the United Kingdom, and Germany is conducted. Furthermore, the paper highlights potential challenges pertaining to the recognition and enforcement of AI-assisted arbitral awards under the 1958 New York Convention and the UNCITRAL Model Law. Specific recommendations for the amendment and enhancement of the legislation of the Republic of Uzbekistan are proposed.
