Abstract

This article provides a scientific and theoretical analysis of the civil law nature, legal essence, and principal functions of personal non-property rights in the digital environment. It examines the role of these rights in identifying the results of intellectual activity and highlights their importance in ensuring the legal and social connection between the author and the work. The distinctive features of the regulation of personal non-property rights in continental and Anglo-Saxon legal systems are comparatively analyzed. Furthermore, the article substantiates the transformation of these rights in the context of the development of digital technologies, internet platforms, and the digital economy, their impact on the legal regime governing intellectual property objects in civil transactions, and their significance in identifying the right holder, ensuring the authenticity of works, and maintaining the stability of legal transactions.
