IMPROVING PERSONAL DATA LEGISLATION: BEST FOREIGN PRACTICES IN THE USE OF DATA COLLECTED THROUGH PHOTO AND VIDEO RECORDING DEVICES

Abstract

this article examines the legal regulation of relations connected with the installation of surveillance cameras and photo- and video-recording devices and the use of data collected through them. The first section analyzes the current situation in the Republic of Uzbekistan, identifying practical problems — the installation of cameras in inappropriate places, violations of the rights and freedoms of other persons, and the improper use of collected data — as well as gaps in the existing legislation. The second section reviews the advanced foreign experience of the Federal Republic of Germany, the Republic of Korea and the People’s Republic of China in regulating video surveillance, the requirements for installing recording devices, and the procedure for using, storing and destroying the data obtained. The third section develops practical proposals for amending and supplementing the national legislation on personal data. The article substantiates the need to establish clear legal grounds, requirements and limitations in order to ensure a balance between security interests and the constitutional right to privacy.
